- Advising on consensual dissolution prerequisites under Chinese matrimonial law, requiring: joint petition filing at civil registry offices and binding accords on custodial arrangements, equitable distribution of marital estates, and debt allocation. Providing mediation services to facilitate mutually enforceable settlement agreements conforming to jurisdictional equity standards.
Document drafting and review
- Draft the divorce agreement clearly expressing both parties’ voluntary consent to divorce and detailing specific arrangements regarding child custody, property division, and debt responsibility. Review the divorce agreement signed by both parties to ensure compliance with Chinese laws and to protect the legitimate rights and interests of the parties involved.
Procedure assistance
- Guide both parties in preparing the necessary documents for divorce registration, such as the valid passport and marriage certificate. Accompany the parties to the marriage registration authority to complete the divorce registration procedures, and assist in resolving any issues encountered during the process.

Consultation on jurisdiction and application of law
- Assist in determining the court of jurisdiction. Generally, foreign-related divorce litigation is under the jurisdiction of the court at the defendant’s place of residence or, if the defendant is not in the country, the court at the plaintiff’s place of residence. Inform the parties that the law of the court’s location applies to the divorce proceedings; however, if the parties agree to apply foreign law and it does not violate the fundamental principles of Chinese law and the public interest of society, such application may also be permitted.
Representation(agency)
- As retained litigation counsel in divorce proceedings, we provide full-cycle representation encompassing: drafting pleadings and evidentiary disclosures; conducting courtroom advocacy through opening/closing statements, evidence presentation, and cross-examination; and pursuing favorable dispositions through court-facilitated settlement conferences with opposing parties.
Delivery and procedural assistance
- Due to the involvement of foreign parties, procedures such as the service of litigation documents are more complex, lawyers need to assist the court in completing the service work in accordance with the relevant regulations on foreign-related service. At the same time, explain each link and note of the litigation procedure to the client to ensure that they understand and can cooperate with the litigation process.

Visa processing, green card application, and application for naturalization
Client Z is a Chinese citizen who is married to an American citizen, XX, and they have two American children. Later, his or her spouse submitted an IR1 spousal immigration application for him or her. The XX Consulate issued an IR1 visa, and Client Z entered the United States as a permanent resident in the same year.
Client D, a Chinese citizen, married an American citizen and they have a son (of American nationality). Later, his or her spouse submitted an I-130 spousal immigration application for XX and it was approved. With the assistance of the Lawyer team, Client D completed the relevant document preparation and interview guidance, and was issued an IR1 visa to enter the United States. In the same year, they obtained a green card. The lawyer team subsequently initiated the application for naturalization and expedited the process through his spouse's position in an American company. The case involved challenges such as Client D's first B1/B2 visa rejection and the revocation of their children's nationality. The lawyer team ensured the legality and efficiency of the immigration path by supplementing the authenticity of the marriage, coordinating the compliance of laws in China and the United States, and facilitating cross-departmental communication. At present, the green card of Client D is valid, the application for naturalization is pending approval, and the issue of children's nationality has been properly handled through the travel document and revocation application.
Application for Chinese Green Card
During the process of assisting XX's son in applying for an entry and exit permit, the lawyer team formulated a detailed full-process case schedule of "application document preparation - application submission - approval and certificate collection", and clearly defined the task division. They also conducted research on the regulations of Zhumadian area, obtained the contact numbers of the public security bureau and other departments to sort out the processing requirements and procedures. Draft and review documents such as the "Application and Approval Form for Extension and Reissuance of Hong Kong, Macao, Taiwan and Overseas Chinese Documents", and guide XX to fill in and prepare the materials.
