Nationality


(1)Nationality confirmation and conflict resolution

Nationality status confirmation

  • Assist in confirming an individual’s legal status of nationality in China (e.g., whether the person is regarded as a Chinese citizen). 
  • Resolve legal conflicts arising from dual nationality status (Note:China does not recognize dual nationality, special attention must be paid to Article 3 and Article 9 of the Nationality Law of the People's Republic of China). 

Nationality conflicts resolution  

  • Resolve nationality conflicts arising from birth, marriage, or naturalization (e.g., determining the nationality of children born in intermarriages).  
  • Provide legal assistance in the renunciation of original nationality or the submission of nationality declarations (e.g. matters related to the restoration or relinquishment of Chinese nationality).  

(2)Naturalization, renunciation of nationality and restoration of nationality 

Apply for Chinese nationality  

  • Guidance on meeting the conditions for naturalization under Article 7 of the Nationality Law (such as bing a near relative of foreign nationals, having settled in China.).  
  • Assist in the preparation of required documents (such as a certificate of no criminal record, proof of financial origin.) and submitting the application to the public security authorities.  

Renunciation of Chinese nationality  

  • Proxy application for renunciation of nationality (subject to approval by the Ministry of Public Security, applicable Article 10 of the Nationality Law).  

Restoration of Chinese nationality  

  • Provide legal support for the restoration of Chinese nationality to foreigners who once held Chinese nationality (subject to Article 13 of the Nationality Law).  

(3)Visa and residence-related services   

Visa application and change  

  •  Assist with the processing of work visa (Z visa), family visit visa (Q visa), etc., and ensure a match with nationality status.   
  • Handle visa type adjustments due to nationality changes (such as the need to change residence permits after renouncing the original nationality).   
  • Foreign Permanent Resident ID card(Chinese’s green card)
  • Guide the application for long-term residence or permanent residence status (subject to the Regulations on Examination and Approval of Permanent Residence of Aliens in China ).

(4)Family and property matters   

Intermarriages and children's nationalities   

  • Resolve nationality determination issues for spouses and children in international marriages (e.g., determining children’s nationality according to Articles 4-5 of the Nationality Law).   
  • Assist with procedures such as foreign-related birth registration and passport applications.   

Property rights and inheritance   

  • Address property ownership restrictions arising from nationality changes (such as real estate purchases and equity investments).  
  • Plan cross-border inheritance to ensure compliance with Chinese laws and nationality-related restrictions.   

(5) Legal disputes and litigation representation   

Administrative litigation  

  •  Apply for administrative reconsideration with the Exit-Entry Administration of the Public Security Bureau, or file a lawsuit in court (such as in cases of visa refusal or residence permit cancellation).  

Civil and criminal cases   

  • Handle contract disputes and labor disputes arising from nationality issues (such as disputes over the legal status of foreign employees).   
  • In criminal cases, assist foreign parties in exercising consular protection rights or nationality-related defense.  

(6)Application of international law and treaties    

International conventions and bilateral agreements  

  •    Explain the impact of international treaties signed by China (such as Double Taxation Avoidance Agreements and Extradition Treaties) on nationality issues, and interpret the application of relevant provisions in nationality-related matters.  

Extradition and judicial assistance     

  • Assist in handling cross-border legal issues involving nationality, such as nationality-based defenses in extradition requests.

Case recommend

Visa processing, green card application, and application for naturalization

Client Z is a Chinese citizen who is married to an American citizen, XX, and they have two American children. Later, his or her spouse submitted an IR1 spousal immigration application for him or her. The XX Consulate issued an IR1 visa, and Client Z entered the United States as a permanent resident in the same year.

Client D, a Chinese citizen, married an American citizen and they have a son (of American nationality). Later, his or her spouse submitted an I-130 spousal immigration application for XX and it was approved. With the assistance of the Lawyer team, Client D completed the relevant document preparation and interview guidance, and was issued an IR1 visa to enter the United States. In the same year, they obtained a green card. The lawyer team subsequently initiated the application for naturalization and expedited the process through his spouse's position in an American company. The case involved challenges such as Client D's first B1/B2 visa rejection and the revocation of their children's nationality. Application for Chinese Green Card

During the process of assisting XX's son in applying for an entry and exit permit, the lawyer team formulated a detailed full-process case schedule of "application document preparation - application submission - approval and certificate collection", and clearly defined the task division.
